Fixed-Term Contracts

Fixed-term contracts are permitted, but may not exceed one year for lower skilled Workers or five years for higher-skilled Workers. They may be extended expressly or impliedly by the individual continuing to work after the end of the term. If the individual is unjustly dismissed before the expiration of the term or the end of the work (for a project or specific job), then a Judge may order payment of the remaining wages that the individual would have otherwise have earned.

Worker Classifications

Peru does address lower skilled employees separately from higher skilled employees for purposes of employment law, with more restrictiogs generally imposed on the former.

Probationary Periods

Probationary periods are referred to as trial periods in Peru. They are permitted for a maximum of 30 days for domestic service personnel or unskilled Workers, 60 days for skilled workers or apprentices, and a mutually agreeable period for highly specialized technical Workers. Either party may terminate the employment contract during the trial period without notice or severance requirements.

Holidays

There are 13 national holidays in Peru, which are treated as mandatory rest days. If work is performed on a national holiday, wages are due at 200%.

Vacation

Workers are entitled to 20 days of sick pay from the employer for the first 20 days of injury or illness. A medical certificate is required. As of the 21st day, the Peruvian government picks up payments to the Worker for the duration of the incapacity so long as they cannot work. The government payments are capped at 11 months and 10 days of consecutive incapacity.

Overtime

Overtime is considered that in excess of the standard working day and is payable at a rate determined by the applicable collective bargaining agreement. In all cases, the first two hours of overtime must be paid at least at 125% and every hour after that should be at least 130%.
