Fixed-Term Contracts

Fixed-term contracts are permitted in Russia only for specifically authorized reasons (e.g. replacing a colleague, secondary employment, etc.) and for no longer than five years. Fixed-term contracts entered into for a reason other than those authorized in the Labour Code will be deemed indefinite. A fixed-term contract in Russia does not automatically terminate at the end of the term. Rather, the employer should serve three days' written notice and follow the standard termination procedure.

There are no official subcategories of Workers in Russia.

Probationary Periods

Probationary periods of up to three months are permitted for most Workers in Russia. However, they cannot be used in contracts with specific categories of employees including pregnant women, women with children under one and a half years old, and minors under the age of 18. An employment contract can be terminated during the probationary period with three days' written notice.

Holidays

Workers recognize 14 paid public holidays. Work performed on a public holiday should be paid at 200%.

Vacation

Employers are responsible for paying a Worker's salary during the first three days of absence for injury or illness. After that, the Worker will receive a temporary incapacity allowance from the government.

Overtime

Any work over the 40 hour standard is considered overtime. Overtime work is not prohibited except in the case of pregnant women, minors under the age of 18, and some other specified categories of Workers. When not prohibited, overtime generally requires the Worker's consent and a premium rate. The first two hours should be paid at 150% and 200% for every hour after that. Overtime work should not exceed four hours for two days in a row or 120 hours per year.
