Employment Agreement


  • Official employer of record: TCW Services Canada
  • Written employment contracts are not legally required in Canada, however, TCW Services Canada as the official employer of record for employees based in Canada will provide written contracts.

Termination Notice

  • There is no employment “at will” in Canada.

  • Notice may vary by province, however, generally employees are entitled to one week’s notice for employment lasting longer than 3 months, but less than one year; and two weeks’ notice for employment lasting longer than one year, but less than five years.

  • Payment in lieu of notice is allowed. Severance pay varies based on length of employment and by province.

What you need to know

Average work week
The average workweek for most provinces is 8 hrs/day or 40 hrs/wk but goes up to 44 hrs/wk in Alberta, New Brunswick, and Ontario and 48 hrs/wk in Nova Scotia and Prince Edward Island.
Holidays
There are approximately 8 public holidays in Canada but this varies by province. Hours worked on holidays are generally compensated at a higher rate.
Overtime Pay
Overtime is generally paid at 150% of the employees’ regular wages. There are some exceptions. Also, in British Columbia, overtime rises from 150% to 200% after 12 hrs/day.
Vacation/Sick Leave
Vacation in Canada has two parts: time away from work and vacation pay. A Worker’s vacation time and vacation pay entitlement depend on the province/territory. In many provinces, Canadian employees are entitled to 2 weeks per year for employees with 1-5 years’ continuous service and pay in the amount of 4% to 6% of the worker’s gross salary. Workers are entitled to varying amounts of paid or unpaid sick leave depending upon the province/territory.
