Fixed-Term Contracts

Fixed-term contracts are permitted for a total cumulative duration of 10 years. A fixed-term contract can only be terminated early on lawful grounds (ex. Misconduct, poor performance, economic reasons) and must follow applicable notice requirements based on tenure. A Worker must also be provided 30-day notice prior to the end of the fixed term contract if it is not intended to be renewed

Holidays

Kosovo has 12 public holidays annually.  If a public holiday falls on a weekend, the next working day may be observed as a non-working day in accordance with national regulations. If a Worker performs work on a public holiday, they are entitled to compensation at 150% of their regular rate of pay.

Vacation

In Kosovo, Workers are entitled to at least 20 working days of paid annual leave per year.  One additional day of leave is added for every 5 years of service

Probationary Periods

The maximum duration of a probationary period is six months. During probation, either party can terminate the contract with at least 7 days’ notice.

Sick Leave

Workers are entitled to receive at least 100% of their regular salary for the first 20 days of sickness. A medical certificate can be requested if the absence lasts for more than three consecutive days.  If the Worker is unable to work for more than 20 days due to sickness, the Worker is then compensated through Social Security.

Working Hours

A standard work week is 8 hours per day, 40 hours per week. 

Overtime

Overtime is permitted but cannot exceed 8 hours per week.  Overtime during the work week is paid at 130% of the Worker’s regular rate of pay.  Overtime on weekends or a national holiday is paid at 150%.

Termination

In Kosovo, termination of a Worker is only allowed for valid reasons, such as by mutual agreement, redundancy, illness, poor performance A Worker must be provided notice as follows based on tenure:

•    up to 2 years of service: 30 days’ notice
•    Between 2 years of service and 10 years of service: 45 days’ notice
•    Over 10 years of service: 60 days’ notice

Other End of Employment Rules

For a Worker terminated as part of a collective dismissal, business related decisions (redundancy), or dissolution of a business, the Worker will be entitled to severance based on tenure as follows:
•    At least two years but less than four years: one month’s salary
•    At least four years but less than ten years: two months’ salary
•    At least 10 years but less than 20 years: three months’ salary
•    At least 20 years but less than 29 years: six months’ salary
