Fixed-Term Contracts

Fixed-term contracts are permitted in Poland but can only be renewed 3 times, with a limit of 33 months for the same employer . After that the contract will be deemed indefinite. For Temporary Worker contracts, the maximum duration is 18 months.

Holidays

In Poland, Workers recognize 14 national public holidays. Generally, work performed on a public holiday must be compensated by a day off in lieu or a pay premium equal to 100% of the Worker’s salary. If the holiday falls on a Saturday, the worker is entitled to a compensatory day off.

Vacation

In Poland, workers are entitled to 20 days a year if less than 10 years of work history, and workers with more than 10 years of work history (including education) are entitled to 26 days a year. Annual leave accrues monthly, and if unused, it will be payable at termination. For workers on Temporary Worker Contracts, annual leave is 2 days/each month worked.

Probationary Periods

In Poland, probationary period are allowed for up to 3 months. A renewal of a probationary period is only allowed if the worker performs a different role or type of work. Probationary periods are not permitted for temporary work contracts.

Sick Leave

Workers are entitled to 80% of their pay when unable to work due to illness, which is paid for by the employer for the first 33 days. In the case of pregnancy related illness workers are entitled to 100% of their pay.

Working Hours

Working hours in Poland are 8 hours per day, 40 hours per week.

Overtime

Under the Polish Labour Code, workers maybe be entitled to a pay premium for work more than 8 hours per day or 40 hours per five-day workweek of 150% of their standard day and 200% for work performed on a Sunday or public holiday. The maximum annual overtime limit is 150 hours, unless under a collective bargaining agreement that states more.

Termination

"Unless on a fixed-term agreement or in cases of serious misconduct, Workers must be given advanced written notice before terminations. Termination notice is as followed: 2 weeks notice for workers with less than 6 months seniority , 1 month notice for workers with more than 6 months but less than 3 years seniority , and 3 month notice for workers with more than 3 years seniority. The amount of written notice for workers on temporary employment contracts is one week."

Resignation

The length of notice is based on the Polish Labour code. Notice is as followed: 2 weeks notice for workers with less than 6 months seniority , 1 month notice for workers with more than 6 months but less than 3 years seniority , and 3 month notice for workers with more than 3 years seniority. Workers can resign without notice in case of serious breach by employer.
